5. Grant # 712, Cabarrus NC, ent. 19 Aug 1845, sur. 26 Sep 1845, iss. ______. Issued to SAMUEL W. ROGERS, being 90 acres on the waters of Anderson’s and Muddy Creek. The metes and bounds are from a hic. (corner of John E. Garmon or Freeman tact, running with his line) south 20 west 30 to pine & p. o. (near Hiram Bost corner), (with Bost’s line) north 60 west 120 to p. o. & stake (on the Dutch Road), (up said road) north 10 east 54 to stake & w. o. stump (on said road, James A. Garmon’s corner), (with three of his lines) south 87 east 27 to w. o., south 50 east 58 (crossing the Fayetteville road) to p. o., north 56 east 76 to p. o. (by said road, Alphonsa Garmon corner), (with his line) north 60 east 106 tp dead pine & p. o. 6. Deed 17-398, Mecklenburg NC, 12 Nov 1789, prv’d Apr 1800. Geo. Graham Esq. late sheriff of Mecklenburg to Henry Smith. The metes and bounds are from a hic. (on the bank of the river) north 80 west 14 ch to pine, south 20 west 11 ch to p.o, south 45 west 21 ch to pine, south 20 west 36 ch to p.o. (on Meeting House Branch), then down the courses of the branch to the river and up the river to Henry Smith’s old corner., then around his old land to begin. (not represented by the plat to the left) Wit: Charles T. Alexander.

Deed 15-99, Mecklenburg NC, 14 Aug 1793, prv’d Jul 1795. Andrew Alexander, Sheriff of Mecklenburg to Leonard Huise, being 125 acres on Rocky River. The metes and bounds are from a pine (on Michael Garmon’s line and with his line) north 80 west 52 to pine (said Garmon’s corner), south 29 west 52 to p. o., south 62 west 80 p. o. to pine, south 8 east 40 to p. o., south 50 east 80 to pine, south 5 west 24 (by a branch), (down said branch) south 74 east 26 to r. o. (on bank of branch), (down the branch) south 56 east 60 to b.o., south 50 east 22 to w. o. (on river bank), (up the river) north 15 east 20 to ash, south 82 west 26 to p. o. (his own corner), then to begin. Also included in this conveyance was another tract of 26 acres situated on the waters of Muddy Creek. Wit: Tho’s McFaddon.

Deed 11-282, Cabarrus NC, 16 Feb 1830, prv’d Apr 1830. Jacob Petre to John Beckwith & Co. of Wake County NC. Situated on the west side of Rocky River, this tract has changed a little in shape and length of lines. The branch on the southern line is now known as “the Malling branch” adjoining the ‘Rung’ land as it meanders to the river. Wit: Isaac Watson, J. W. Means.

7. Deed 7-84, Mecklenburg NC, 7 Apr 1779. Thomas Polk, Attorney for David Oliphant to Adam Garmon. SHADED IN RED on the key map, this tract is 72 acres and on the “waters of Rockie River neigh the Caplsse Meeting House.” The tail from a letter “g” in a line above crosses over and make it hard to read what appears to be “Caplsse.” The description likely calls out “neigh the Baptist Meeting House.” The metes and bounds are from a b. j. north 27 east 132 to b. o., north 65 west 80 to p. o., south 31 west 189 to pine, then to begin. Wit: Wm. Polk, Phillip Miller.

Deed 11-31 Mecklenburg NC, 12 Sep 1779, prv’d ____. Adam (A) and wife ________(X) Garmon to Henry Kent. (from F-1, Wake NC), Henry Kent, and also signed by Martha Kent, of Mecklenburg NC sold to Davie Strait 125 acres on Utley Creek in Wake County adjoining Sampson Wood. The land was granted to Henry Kent 1 Apr 1780. Wit: Sampson Holland, Sampson Wood. With one major exception, this land description is the same as that from deed 7-85 above. In this deed, the wording clearly states the land is “near the Baptist Church.” Identified in land records, the branch running below this tract towards Rocky River is known as Meeting House Branch. It was known by that name up through the mid 1840’s when it took on the name “John Garmon’s branch.” A man named Hezekiah Bryant once lived nearby before removing to Tennessee. His revolutionary War pension application states he was born in SC, entered the revolutionary war in Wake County NC, and thereafter married Mary, a daughter of John Powell in then Mecklenburg County NC. The marriage bonds were posted at “Haynes Meeting House.” No such bond survives in the records of Mecklenburg County. But there was a William Haynes who owned lands nearby to this tract. There is an ancient cemetery located on a most beautiful knoll over looking the watershed of Meeting house Branch. Though not readable, I did find two stones with writing. In 1933 Clark Howell, editor of the Atlanta Constitution, wrote a Howell family history in which he states that the mother of Joseph Howell is buried at “Hains Church Yard” In Cabarrus County. The present day owner of the land surrounding the cemetery had been told the it may belong to the Green Family. It is my belief the cemetery is the resting spot for those who attended Haynes Meeting House, Contemporary to the earliest records of Rocky River Baptist Church, apparently this is an expansion of an early arm of Sandy Creek Baptist springing from Chatham County NC. Isaac Garmon later owned this land along with that wrapping around it. Witnesses for this deed are Rees Shelby and Leonard Green.

7. Deed 13-892, Mecklenburg NC, 18 Jun 1785, prv’d Apr 1791. Thomas Harris Esq., late Sheriff of Mecklenburg NC to Isaac Garmon. Wit: Charles Harris, Isaac Garmon. Being 100 acres on Rocky River “Running round his old survey.” Wrapping around the west side of the red shaded tract identified above, the metes and bounds are from p. o. (on the wagon road) south 60 east 116 to pine, south 27 west 40 to small p. o. (his old corner), (with his line) north 63 west 80 to p. o., south 31 west 134 to pine (his corner), (with his open line) south 35 east 90 to b. j. (his corner), south 26 west 76 to b. j., west 80 to b. o., north 22 west 80 (near David Powell’s line) to stake, then to begin. Wit: Charles Harris, Wm. Cupples.

Deed 5-14, Cabarrus NC, 18 Oct 1803, prv’d _____. Isaac Garmon to John Reed. Wit. James Love, Jonah Love.

Deed 10-30, Cabarrus NC, ____1811, prv’d _____. John Reed Sen’r to Henry Reed. Being two pieces of land on the west side of Rocky River adjoining each other “put in one tract” so as to make up 200 acres where “the said Henry Reed now lives.” Wit: William Creaton.

Deed 10-367, Cabarrus NC, 15 Apr 1826, prv’d Oct 1826. Daniel Sossamon to Tobias Klutts. Being 122 acres on the southwest side of Rocky River on a branch of same. The metes and bounds are now from a stake, (east side of Charleston Road, south 60 east 120 to a stake, then south 25 west 172 (along Garmon’s line) to w. o ) corner of Elizabeth Leopard, north 65 west 146 to stake (corner of Leopards), then north 30 east 186 to begin. Wit: Henry Reed, Wm. Gilliam.

Deed 12-79, Cabarrus NC, 1833, prv’d—. Tobias Klutts to Green M. Burkhead, being the same 172 acres as described in Deed 10-367 above. Wit. Robert S. _____, & Sam’l C. Klutts.

Being 98 acres, the metes and bounds are from b. o. north 32 east 40 to pine, north 55 east 40 to small p. o., north 60 to two pines (on a small branch), north 20 west 54 to pine, north 68 west 38 to hic., south 24 west 148 (along Isaac Garmon’s line) to stake, north 60 east 3 to b. j. (Isaac Garmon’s corner), south 82 to pine, south 53 east 26 to hic., then to begin. Wit: ______________

Deed 13-394, Cabarrus NC, 15 Nov 1841. prv’d ____. John E. Garmon to James S. Burkhead. Wit: Henry Garmon. To settle debts, John Garmon sold all his standing crop, household furniture and the 98 acres tract adjoining J. S. Burkhead and David Kiser. Wit: Henry Garmon.

Being 60 acres, the metes and bounds are: from ash (on the bank of the river at the mouth of Meeting House Branch) south 5 east 16 to large w. o. (Kiser’s corner), (with his line) south 70 west 66 to pine (at his corner), (his other line) south 48 to pine, south 75 west 104 to pine, north 64 west 18 to p. o. sapling (in Michael Garmon’s line, north 58 east 48 to p. o. (Garmon’s corner), (with this other line) 70 poles to two pines on branch, then down the Meeting House Branch to the begin. Jurat: James Little, (Bonner (x) Bird.

Deed 5-194, Cabarrus NC, 26 Oct 1795, prv’d ____. George Graham Esq., late sheriff of Mecklenburg to Calib Wolf by his agent Charles T. Alexander. Being two tracts. The first of which contains 60 acres “which was conveyed from Calib Wolf to Peter Long. Beginning at an ash at the mouth of Meeting House Branch & runs courses… (turn back to page 190).” The second tract ————————– Wit: Charles T. Alexander, David Kiser.

Deed 5-191, Cabarrus NC, 1 Aug 1804, prv’d Jan 1805. Peter (x) Long to George Kiser. Being 60 acres at the mouth of Meeting House Branch. Wit: Samuel McCurdy.

Deed 6-44, Cabarrus NC, 22 Oct 1805, Oct 1805. George Kiser to David Kiser. This 60 acres is the second of two tracts conveyed. The first tract is for 53 acres adjoining tract two. (See 1-164 above). Wit: Mark Kiser, Esther ( ^ ) Keiser.

11. Deed 1-164, Cabarrus NC, 26 Feb 1779, prv’d Apr 1795. Wm. Polk of then Mecklenburg to George Kyser. Being 53 acres on the south side of Rocky River below John Johnston’s. The metes and bounds are from b. o. (on the ridge) north 70 east 66 to l.o. (on the river bank), (down the river) south 33 east 80 to b. o., south 45 east 44 to p. o. (on river bank), north 86 west 120 to p. o. (in a draft), then to begin. Wit: Cha’s Polk.

Deed 6-44, Cabarrus NC, 22 Oct 1805, Oct 1805. George Kiser to David Kiser. This 53 acres is the first of two tracts conveyed. The second tract is 60 acres adjoining tract one and Meeting House Branch. (See 5-190 below). Wit: Mark Kiser, Esther ( ^ ) Keiser.

12. Deed 10-288, Cabarrus NC, 6 Nov 1824, prv’d Jul 1825. Being 230 acres from Thomas Kiser to Nathan Green. The metes and bounds are from a p.o (on the river bank), south 82 west 96 to p.o., west 126 to pine, south 42 west 90 to p.o. (in Garmon’s line), south 45 west 18 to hic. (in said line, McLarty’s corner), (with the division line between him & McLarty) east 174 to p.o., south 39 ½ east 110 to r.o. (the old line with said line), north 80 east 24 to bank of river, up the river to begin. Wit: Wm. Waddington, David Kiser.

Deed 29-36, Cabarrus NC, 10 Feb 1877, prv’d Sep 1878. James M. (x) and wife Elisabeth (x) Little to Eli Hinson. Being 230 acres known as “the Nathan Green land.” Adjoining lands of Michael Garmon to the north. Wit: J. C. Brumbley.

13. Deed 3-120, Cabarrus NC, 20 Jul 1798, prv’d ______. Allen Freeman Junior sold 95 acres to Henry Kegal (Cagle). The metes and bounds are from an elm (on the bank of the river, John Powell’s corner), north 31 west 46 to w.o., south 55 west 68 to p.o., north 19 west 86 to shoal (on Muddy Creek), then down the creek and up the river to begin. 4. Deed 7-31, Cabarrus NC, 6 Jan 1807. John (x) Powell to Alexander McLarty, being 208 acres on the waters of Rocky River. Deed 14-397, Cabarrus NC, 16 Apr 1839. John Reed to Andrew Hartsell. Being all the land nested south of tract 12, east of tract 16 and north of tract 17. The point where this tract metes tract 12 at the river is now listed as joining Needtham Green and McLarty. Wit: George Barnhardt, Leonard Hartsell.

Deed 21-179, Cabarrus NC, 22 Nov 1860. J. L. Bundy, Esq. to Michael Garmon. By virtue of and execution issuing against the property of Nimrod Hartsell in sum of $400 was received to J. J. Long, Guardian of Watson _____ and said Nimrod Hartsell. This tract takes in tract 14 and extends up to take in tract 15. 18 & 19. Deed 11-289, Cabarrus NC, 14 Apr 1830. Moses Archibald to Seneca Turner. “Whereas on the 20th day of Oct 1829, the said Archibald was joined in marriage with Ferebe J. Wallace, his present wife & the said Ferebe J. Wallace aforesaid was indebted at the time of her marriage with said Archibald ….in heritance from her father and former deceased husband …on the west side of Rocky River.” This deed is for the two tracts 18 & 19 on the key map.
